Step-by-Step: How to Register a Trademark in India
Step 1: Conduct a Trademark Search
Tool: IP India Public Search
Check if your desired brand name/logo is already registered
Search under Class 25 (Apparel) + Class 35 (Retail)
Step 2: Prepare Documents
You’ll need:
Brand name/logo in .JPEG format
Identity proof of applicant (PAN/Aadhar)
Address proof of business
Signed TM-A form
MSME/Udyam certificate (for 50% govt fee discount)
Step 3: File Trademark Application
Where: Online at IP India WebsiteFee:
₹4,500 (individual/startup/MSME, per class)
₹9,000 (companies, per class)
Alternatively: Use legal platforms like Vakilsearch, LegalWiz, or a local IPR lawyer for assistance.
Step 4: Get TM Number and Start Using ™
Once filed, you get a TM application number. You can now use the ™ symbol (pending status).
Step 5: Examination by Trademark Office
Office may raise objections based on similarity or descriptiveness
You or your attorney may have to respond or attend a hearing
Step 6: Publication in Trademark Journal
If approved, it will be published for 4 months
Others may file oppositions (rare unless brand is disputed)
Step 7: Registration Certificate & ® Symbol
If no opposition, you get the registration certificate in ~6–12 months.You can now legally use the ® symbol.
